Description:... The purpose of this Report is to publish the transcript of the evidence of a meeting with the Minister for Europe to discuss a number of questions arising from the Committee's 42nd report, (HL 227, session 2005-06, ISBN 9780104009291), and subsequent correspondence, and to draw the attention of the House to three matters especially. In particular the Committee was concerned to learn about the prospects of the so-called passerelle in Article 42 of the Treaty on European Union (which would transfer certain criminal law competence to the Community) and to inquire about the progress of a number of legislative proposals affected by the ruling of the European Court of Justice (ECJ) in Case C-176/03 where there is an impasse between the Commission and the majority of Member States. The meeting also provided the opportunity to question the Minister on a number of other issues, including the proposal to extend the competence of the ECJ over justice and home affairs matters.
